This website and store are operated by Smith & Smith Innovations Ltd, company number 16617498, registered in England and Wales. Our registered office is 40 South View, Belmont, Bolton, BL7 8AS, United Kingdom.

EverPetal is a trademark owned by Smith & Smith Innovations Ltd. In these terms, “EverPetal”, “we”, “us” and “our” refer to Smith & Smith Innovations Ltd.

2. These terms

These Terms of Service govern your use of this website and purchases made through it. They should be read together with our Delivery, Returns & Refunds and Privacy policies.

Nothing in these terms limits rights that cannot lawfully be limited, including your statutory rights as a consumer.

3. Product information

We take reasonable care to describe and photograph our products accurately. Colours may appear differently between screens, and individually wired stems can be shaped into slightly different positions. Minor variations caused by shaping or normal manufacturing tolerances are not faults.

Measurements are approximate and usually describe the basket after shaping. Wall brackets and wall fixings are not included unless a product listing expressly says otherwise.

Outdoor artificial flowers will weather gradually. UV resistance and weather resistance do not mean permanently fade-proof. Please read our Care & FAQs before installation.

4. Orders and contract formation

Submitting an order is an offer to buy the products in your basket. We will send an order acknowledgement by email. A contract is formed when we accept the order and begin processing it for dispatch.

We may decline or cancel an order before dispatch if, for example, payment is not authorised, stock information is incorrect, there is an obvious pricing error or we cannot deliver to the address supplied. If payment has already been taken, we will issue a full refund.

Please check your delivery address, contact details and order carefully before submitting it. Contact us promptly if you need a change; we cannot guarantee changes after dispatch.

5. Prices and payment

Prices are shown in pounds sterling and include applicable UK taxes unless stated otherwise. Delivery charges and available services are displayed at checkout.

Promotional prices and discounts may be subject to additional stated conditions and may be changed or withdrawn before an order is placed. A change will not affect an order we have already accepted.

6. Delivery and risk

Our delivery services, charges and estimates are explained on the Delivery page. Delivery dates are estimates unless we expressly agree a guaranteed date.

For consumer orders, responsibility for loss or damage passes to you when the goods are delivered into your physical possession, or to a person you nominate to receive them. This does not apply where you independently commission a carrier that we did not offer.

If an order is delayed significantly, lost or damaged in transit, contact us and we will investigate and provide the remedy required by law.

7. Cancellation, returns and refunds

Our 30-day change-of-mind offer, return instructions, refund timing and process for damaged or faulty goods are set out in our Returns & Refunds policy.

All products currently sold through the website are standard designs. If genuinely bespoke or personalised products are introduced, any different cancellation terms will be made clear before purchase.

8. Installation and safe use

You are responsible for choosing and maintaining a bracket, wall fixing and supporting structure suitable for the complete basket and its location. If you are uncertain about the fixing or wall material, use a competent installer.

Keep products away from naked flames and high-temperature sources. We do not currently claim a fire-resistance certification for the retail EverPetal basket.

9. Trade and commercial customers

Standard products purchased through the website are covered by the published website policies. Separately quoted bulk, bespoke, installation or commercial work may be subject to written terms agreed before the order is accepted.

Consumer-only cancellation rights do not apply where a customer is acting wholly in the course of a business, although this does not affect any other rights or any additional return terms we expressly offer.

10. Intellectual property

The EverPetal name, product imagery, written content, branding and original website materials are owned by or licensed to Smith & Smith Innovations Ltd. They may not be copied, republished or used commercially without permission, except where the law permits.

11. Website availability and third-party services

We may update, correct or temporarily suspend parts of the website. Links and services supplied by third parties—including payment, account, tracking and delivery services—may be governed by their own terms. We are not responsible for third-party websites we do not control.

12. Our responsibility to you

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

For consumers, we are responsible for losses that are a foreseeable result of our breach of these terms. We are not responsible for business losses arising from a consumer purchase, or for damage caused by unsuitable installation, misuse, unauthorised alteration or failure to maintain the supporting bracket and fixings.

13. Personal information

How we collect and use personal information is explained in our Privacy policy. Our store is hosted by Shopify, which provides the ecommerce platform used to sell our products.

14. Governing law

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK, you retain any mandatory protections and may generally bring proceedings in the part of the UK where you live.
